They govern your access to and use of our websites, pages, forms, educational content, chat, phone, SMS, email, and related services (collectively, the “Services”).
If you do not agree to these Terms, do not use the Services.
1. Acceptance of Terms
By accessing or using the Services, you confirm that you have read, understand, and agree to be bound by these Terms and by our Privacy Policy. If you are using the Services on behalf of a business or other entity, you represent you have authority to bind that entity.
2. No Insurance Advice
Help for America is a marketing and educational platform. We may provide general information about health insurance topics and may help connect consumers with licensed insurance agents, agencies, carriers, or other service providers.
ELIGIBILITY AND AGE RESTRICTION
The Services are intended for individuals who are 18 years of age or older and located in the United States. By using the Services, you represent you are at least 18.
Help for America is not an insurance company and does not itself underwrite insurance. Unless explicitly stated otherwise, Help for America is not acting as your insurance agent, broker, or advisor.
NO PROFESSIONAL ADVICE
Information on the Services is provided for general informational purposes only and is not legal, financial, tax, or insurance advice. Coverage options, pricing, eligibility, and regulations vary by state and individual circumstances.
You should always consult a licensed insurance agent or qualified professional for advice specific to your situation.
3. User Responsibilities
USER RESPONSIBILITIES
You agree to:
- a. Provide accurate, current, and complete information when submitting forms or communicating with us
- b. Only submit information that belongs to you or that you are authorized to provide
- c. Use the Services only for lawful purposes
- d. Not interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems
- e. Not scrape, harvest, or collect information from the Services using automated means without our written consent
We may suspend or restrict access if we believe information provided is inaccurate, fraudulent, or violates these Terms.
4. Consent to Communications
CONSENT TO COMMUNICATIONS AND TCPA DISCLOSURES
A. Consent when you provide contact information
If you provide your phone number, email, or other contact information through the Services, you authorize Help for America and our partners (including licensed insurance agents, agencies, and service providers) to contact you about your request and related services.
Contact methods may include email, SMS text messages, phone calls, and voicemail. Where required by law, these communications may include contact using an automatic telephone dialing system and prerecorded, artificial, or AI generated voice.
B. Consent is not required as a condition of purchase
Your consent to receive marketing calls or texts is not required as a condition of purchasing any goods or services.
C. Do Not Call registries
If you provide consent to be contacted, you understand you may receive communications even if your number is on a federal or state Do Not Call registry. You may withdraw consent as described below.
SMS PROGRAM TERMS
This section describes our SMS use cases and required disclosures. It applies if you opt in to receive text messages from Help for America.
A. SMS use cases and message types
If you opt in, messages may include:
- Service and informational messages, including responding to requests, verification, reminders, appointment or call scheduling, and status updates
- Marketing and promotional messages, including offers, announcements, and service information that may be relevant to your request
- Security and compliance messages, including fraud prevention and account or intake related notices

Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and is subject to effective transmission from your mobile carrier and device settings. Standard carrier rules may apply.

We may maintain records of your opt in and opt out status, including the date, time, and source of consent, to support compliance.
5. Intellectual Property

The Services may include links to third party sites or may connect you with third parties such as licensed insurance agents, agencies, and carriers. We do not control third party websites, products, or services, and we are not responsible for their content, practices, or availability.
If you choose to engage with a third party, your relationship may be governed by that third party’s terms and policies.
7. Disclaimers
DISCLAIMERS
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELP FOR AMERICA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, error free, or free of harmful components.
8. Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELP FOR AMERICA AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
If liability is found, our total liability for any claim will not exceed one hundred dollars ($100) or the amount you paid us, if any, in the 12 months before the event giving rise to the claim, whichever is greater.
Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
9. Governing Law
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Help for America and its affiliates, owners, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- a. Your use of the Services
- b. Your violation of these Terms
- c. Your violation of any law or third party rights
- d. Any information you submit that is inaccurate, unlawful, or unauthorized
TERMINATION
We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive, including IP, disclaimers, limitation of liability, and indemnity.
CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Effective Date” will reflect the most recent version. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. You agree that any dispute not subject to arbitration (if applicable) will be brought in state or federal courts located in Delaware, and you consent to jurisdiction and venue there.
If you want arbitration language similar to your Legal Giant terms, tell me and I will add a consumer friendly arbitration section that is still enforceable.
